Privacy Policy

Your photos are yours. We collect as little as we can, we don't keep your photos, and we never sell your information. Here's exactly what that means.

This Privacy Policy describes how 2021076 Ontario Corporation ("Mend Memories," "we," "us," or "our") handles information in connection with the Mend Memories app for iPhone and iPad and the website at mendmemories.com (together, the "Service"). By using the Service, you agree to the practices described here.

The short version

What we collect, and why

Your account (Sign in with Apple)

We use Sign in with Apple solely to create and secure your account, so your purchases and remaining mends stay associated with you across sessions and devices. Through this, we receive a unique identifier assigned to you by Apple. We do not request your name or email address, and we don't set up a separate username or password. The only time we'd receive your email is if you choose to write to our support address.

The photos you choose to restore

When you select a photo and tap a restoration action, that photo is transmitted securely to our AI image-processing provider so the restoration can be performed and the finished image returned to your device. We use your photo for one purpose only: to carry out the restoration you asked for. We don't store your original photos or restored results on our servers, and we don't build profiles, perform facial recognition, or derive any other information from them.

Purchases

Subscriptions, the one-time Pro actions unlock, and top-up packs are sold through Apple's in-app purchase system. Apple processes the payment; we never receive or store your payment card information. We receive limited transaction and entitlement information from Apple (for example, that a subscription is active, or that a top-up was purchased) so we can deliver the mends and features you've paid for. Apple's handling of your information is governed by Apple's Privacy Policy.

Diagnostics

We don't include any third-party analytics, advertising, or tracking software in the app. If you've opted in through your iOS settings, Apple may share standard, aggregated crash and performance diagnostics with us through App Store Connect. You can turn this off any time in Settings → Privacy & Security → Analytics & Improvements on your device.

AI processing and the third party that performs it

Restorations are performed off your device by a frontier AI image model. We want to be specific about this, because it's the one place your photo leaves your phone.

Where your photo goes When you tap a restoration action, the selected photo and your chosen action are sent to fal.ai (Features & Labels, Inc.), our AI image-processing provider, which generates the restored image and returns it to you. fal acts as our service provider (processor) and handles your photo only on our behalf, only to perform your requested restoration. Your photo is retained by fal only transiently to carry out the processing and is then deleted. Your photos are not used to train AI models. See the fal Terms and fal Privacy Policy.

By selecting a photo and tapping a restoration action, you ask us to send that photo for processing and you consent to this. If you don't want a photo processed this way, don't submit it.

How your information is used

  • To authenticate you and keep your account secure.
  • To perform the photo restorations you request.
  • To deliver the mends, features, and credits you've purchased through Apple.
  • To respond to you when you contact support.
  • To protect the Service against fraud, abuse, and misuse, and to comply with the law.

When information is shared

We don't sell your personal information, and we don't share it for advertising. We share information only with the providers that make the app work, and only as needed:

  • fal.ai — performs the AI photo restoration, as described above.
  • Apple — provides Sign in with Apple and processes all purchases.
  • Railway / Google Cloud — our backend runs on Railway, hosted on Google Cloud Platform. Your restoration request passes through this infrastructure in transit on its way to the AI provider, but your photos are not stored there. Railway maintains a Data Processing Agreement and publishes its subprocessors in its Trust Center.

We may also disclose information if required by law, to enforce our Terms, or to protect the rights, safety, and property of our users or the public. If our business is ever involved in a merger or acquisition, information may be transferred as part of that transaction, subject to this Policy.

How long we keep things

We keep your account identifier and your purchase/entitlement records for as long as your account exists, so your purchases and remaining mends keep working. We don't retain your photos or restored results; the AI provider retains them only transiently to perform the processing. When you delete your account, we delete your account identifier and associated records.

Deleting your account and data

You can delete your account any time from inside the app: open Settings → Delete Account. This removes your account identifier and the records associated with it. Because we don't store your photos, there are no photos on our end to delete. You can also email us at help@mendmemories.com and we'll handle the deletion for you. Note that deleting your account doesn't cancel an active subscription — manage subscriptions in Settings → [your name] → Subscriptions on your device.

Children

Mend Memories is intended for adults restoring their own family photographs. The Service isn't directed to children, and we don't knowingly collect personal information from children under 13 (or under 16 where required by local law). If you believe a child has provided us information, contact help@mendmemories.com and we'll delete it.

Where information is processed

We're based in Canada, and our providers (including fal.ai and Google Cloud) may process information in the United States and other countries. Where the law requires it, transfers of personal information out of your region are made under appropriate safeguards, such as the European Commission's Standard Contractual Clauses.

Your rights and choices

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, to object to or restrict certain processing, and to withdraw consent. The simplest way to exercise most of these is to delete your account in the app, or email help@mendmemories.com. We won't discriminate against you for exercising your rights.

  • Canada (PIPEDA): you may request access to and correction of your personal information.
  • EEA / UK (GDPR): our legal bases are performing our contract with you (running the Service and your restorations), your consent (sending a photo for processing), and our legitimate interests (securing the Service and preventing abuse). You may lodge a complaint with your local data protection authority.
  • California (CCPA/CPRA): we don't sell or "share" your personal information as those terms are defined, and we don't use it for cross-context behavioral advertising. You may request access or deletion.

Security

Photos are transmitted over encrypted connections, we hold as little data as possible, and we don't keep your images. No method of transmission or storage is perfectly secure, but minimizing what we collect is our first line of defense.

Changes to this Policy

If we make changes, we'll update the date at the top of this page, and for material changes we'll provide additional notice in the app or on this site. Continuing to use the Service after an update means you accept the revised Policy.
